There are a few things that we can count on: death, taxes, and PHMSA rating their penalties every year.
In a final rule published on March 21, 2022, several agencies, including the DOT raised civil penalty amounts. In addition, this final rule notes the new DOT civil penalty authority provided in the Bipartisan Infrastructure Law (BIL, enacted as the Infrastructure Investment and Jobs Act).
Of note, the new maximum penalty for a hazardous materials violation increased to $89,678.00, a $5000.00 increase! If the violation includes a death, serious illness, or severe industry, you can expect a whopping $209,249.00 fine.
A more common violation also increased; Training, from $508.00 to $540.00.
What can you do?
All hazmat employers must train employees as well as keep proper records of said training. In addition, they must show due diligence in all other areas including packaging, marking, labeling, shipping papers, placarding, emergency response, and security plans.
